Terms of Service

1. Who we are and what these terms cover

These terms are an agreement between you and turtlely (the operating entity will be named here once formed; "turtlely", "we", "us"). They govern your use of the turtlely website, the trip planning tools, the traveler pages we host, and everything else we provide (together, the "service"). By creating an account or using the service you agree to these terms. If you are using the service on behalf of an organization, you confirm you have authority to bind that organization, and "you" means that organization.

2. The service

turtlely helps people who organize group travel plan itineraries, share trip information with their travelers, and manage rosters, rooming lists, manifests, and related trip paperwork. Parts of the service generate content automatically, including itineraries, travel guides, and podcast audio. Access is currently by invitation while the service is in early access, and features may change, be added, or be removed during this period.

3. Your account

• You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for activity under your account.
• You must be at least 18 years old to create an account.
• Tell us promptly at the contact address below if you believe your account has been compromised.

4. Organizer responsibilities

The service lets you, the trip organizer, enter information about the people traveling with you, and share pages with them. You agree that:

• You have the legal right, and any consent required, to provide the traveler information you enter, including information about minors for whom you are responsible as an organizer.
• You will only share trip links with people connected to your trip, and you understand anyone holding a share link can view the trip page it points to (traveler pages never include roster details, medical or dietary information, or contact information).
• You remain responsible for the accuracy of your trip's details and for your own compliance with policies of your school, organization, or employer.

5. Generated content and trip information

Itineraries, guides, podcasts, and venue suggestions are produced with the help of automated systems and third-party data, and are provided as a starting point, not as professional travel advice. Venue details such as hours, prices, availability, and group policies change: you are responsible for verifying arrangements directly with venues before relying on them. turtlely does not book, operate, or supervise any travel, transportation, lodging, or activity, and is not a travel agency, tour operator, or common carrier.

6. Document templates are not legal advice

Where the service provides templates (for example permission slips, waivers, or medical forms), they are general starting points only. They are not legal advice, we do not warrant they are suitable or enforceable for your situation, and you should have documents that matter reviewed by your own counsel or organization.

7. Acceptable use

You agree not to:

• use the service to violate any law or the rights of others;
• upload content that is unlawful, harassing, or infringing;
• attempt to access another workspace's data, probe or disrupt the service, or circumvent access controls;
• resell or white-label the service without a written agreement with us;
• use the service to collect information about people unconnected to your trips.

8. Your content

You keep ownership of the content you enter into the service. You give us the limited license we need to host, process, display, and transmit that content in order to run the service for you, including processing it with the service providers described in our Privacy Policy. We do not sell your content or use your travelers' personal information for advertising.

9. Fees

Parts of the service may be offered free during early access. Paid plans, when introduced, will be presented with their price before you commit, and these terms will be updated with billing provisions at that time. Early-access pricing shown on our site is a sketch and may change before launch.

10. Third-party services

The service is built on third-party infrastructure and links to third-party sites (for example venue websites and maps). Those services have their own terms, and we are not responsible for them.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURTLELY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF ONE HUNDRED US DOLLARS OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. THE SERVICE IS A PLANNING AND PAPERWORK TOOL: WE ARE NOT LIABLE FOR EVENTS OCCURRING ON TRIPS THEMSELVES.

13. Indemnification

You will defend and hold turtlely harmless from claims arising out of your trips, your content, your breach of these terms, or your violation of law or the rights of others, including claims by travelers or their guardians relating to information you entered or shared.

14. Termination

You can stop using the service and ask us to delete your workspace at any time. We may suspend or end access for breach of these terms, and we may end the early-access program with reasonable notice. Sections that by their nature should survive (including 5, 6, 8, and 11 through 16) survive termination.

15. Changes to these terms

We may update these terms as the service evolves. If a change is material we will notify account holders by email or in the product before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.

16. Governing law and disputes

Governing law and venue will be stated here once the operating entity is formed. Until then, you agree to contact us and attempt to resolve any dispute informally before filing a claim.
